On 6 September 2021, the Serbian Competition Commission (the “Commission”) initiated an ex-officio proceeding against the company MAT – Real Estate from Novi Sad for implementing the transaction before its notification to the Commission (so-called, gun-jumping).
Namely, the mentioned company acquired the company Radijator AD in the bankruptcy proceedings. Having in mind that the company MAT – Real Estate is owned by Matijevic family which holds, among others, IM Matijevic, MPZ-Agrar and ATP Vojvodina, the Commission found out that the relevant merger filing thresholds were met.
If the Commission concludes that the company MAT – Real Estate was obliged to notify the Commission before implementing the transaction, it could be fined up to 10% of the total annual turnover achieved in Serbia, while the Commission may in addition also enact de-concentration measures.
